By taking seriously Locke’s general approach to questions of identity, Boeker shows that we should consider his account of personhood separately from his account of personal identity over time. Decisions related to births in the “gray zone” of periviability are particularly challenging. Despite published management guidelines, clinicians and families struggle to negotiate care management plans. Stakeholders must reconcile conflicting values in the context of evolving circumstances with a high degree of uncertainty within a short time period. Even skilled clinicians may struggle to guide the patient in making value–laden decisions without imposing their own values. Exploring the experiences of one pregnant woman and her caregivers, this case study highlights how (...) bias may undermine caregivers’ ability to meet their obligation to enhance patient autonomy and the moral distress they may experience when a patient’s values do not align with their own. Management strategies to mitigate the potential impact of bias and related moral distress are identified. The authors then describe one management strategy used in this case, facilitated ethics consultation, which is focused on thoughtful consideration of the patient’s perspective. (shrink)

There has been a long tradition of women’s ministry in Baptist Churches in the UK. This article outlines this hidden story, from the pioneering days of women preachers, through the rise of the Deaconess Order, to women’s ordination and the present day. Reports from the Baptist Union show a lively debate, against the backdrop of changing times in the twentieth century. The article looks at women’s representation on national decision-making bodies and in national office. Women were seen as ‘complementary’ to (...) men in nature and ministry, but often did not fit the expected roles. John Locke offered a very rich and influential account of persons and personal identity in “Of Identity and Diversity,” which is chapter 27 of Book 2 of his An Essay concerning Human Understanding. He added it to the second edition in 1694 upon the recommendation of his friend William Molyneux. Locke’s theory was soon after its publication discussed by his contemporaries and has influenced many present-day discussions of personal identity. Distinctive about Locke’s theory is that he argues that the notion (...) of a person is to be distinguished from that of a human organism, or “man” to use Locke’s term, and that of a substance. By distinguishing the notion of a person from the more traditional notions of a human organism and a substance, Locke is able to address moral questions of accountability without having to take a stance on the question of whether the underlying ontological constitution of a person is material or immaterial. The chapter can be divided into two parts: in the first he outlines his general account of identity, and in the second he applies his general account of identity to persons and personal identity. The discussion of Locke’s general account of identity in the secondary literature has focused on whether Locke’s account of identity can be regarded as a version of the thesis that identity is relative and on how Locke understands modes and substances in chapter 27. The secondary literature on Locke’s account of persons and personal identity often focuses on how Locke’s claim that personal identity consists in sameness of consciousness is to be understood. However, some interpreters also draw attention to the importance of the moral and legal dimension which Locke makes explicit in his claim that “person” is a forensic term (II.xxvii.26). Moreover, some scholars have argued that Locke’s theory is to be understood in its religious context. The objections which have repeatedly been raised against Locke include the problem of circularity and the problem of transitivity; Locke’s reference to “fatal error” in II.xxvii.13 has also been regarded as a serious problem for his view. In the 20th century, psychological accounts of personal identity were often called neo-Lockean theories. It is controversial whether neo-Lockean theories differ from Locke’s own theory, and it can be asked whether the moral and religious dimension of Locke’s theory constitutes an important difference. In the study of women in academia, the focus is often particularly on women’s stark underrepresentation in the math-intensive fields of natural sciences, technology, and economics. In the non-math-intensive of fields life, social and behavioral sciences, gender issues are seemingly less at stake because, on average, women are well-represented. However, in the current study, we demonstrate that equal gender representation in LSB disciplines does not guarantee women’s equal opportunity to advance to full professorship—to the contrary. With a cross-sectional survey among (...) N = 2,109 academics at mid-level careers in the Netherlands, we test the hypothesis that in LSB, female academics perceive to hit a “thicker” glass ceiling—that is, they see a sharper contrast between the high representation of women at the lower compared to the top levels. We test whether this predicts female academics’ lower estimated chances to reach full professorship relative to men in LSB. We introduce a novel perceived glass ceiling index, calculated based on academics’ perceptions of the share of women and men in their direct work environment minus their perceptions of gender ratio among full professors in their field. Results confirm that the perceived glass ceiling is thicker in the non-math-intensive LSB compared to math-intensive NTE fields. Furthermore, only in LSB, women perceived a thicker glass ceiling than men. Moreover, only among female academics, the thicker the perceived glass ceiling, the lower their estimated chances to become full professor 1 day. Combined, a moderated mediation showed that for women only, a thicker perceived glass ceiling in LSB compared to NTE disciplines predicted their lower estimated chances to advance to full professor level. No such mediation occurred for men. We conclude that women’s higher numerical representation in LSB disciplines does not negate a male-dominant normative standard about academic leadership and success. Paradoxically, the perceived odds for female academics to reach the top of their field are lower in fields where they are relatively highly represented, and this may pose unique barriers to women’s perceived opportunities for career success. Mastroianni (bio), Ruth Faden (bio), and Daniel Federman (bio)In recent years, claims have been made by segments of the research community and by women's health advocacy groups that clinical research practices and policies have not benefitted women's health to the same extent as men's health. Central to these claims has been an assertion that women have been (...) inadequately represented as subjects of clinical studies and that as a result neither health conditions unique to women—e.g., menopause—nor women's manifestations of health problems affecting both sexes—e.g., heart disease—have been investigated sufficiently.The scientific community, including federal agencies that sponsor and regulate clinical studies, is increasingly responsive to these claims and is taking steps to raise the level of women's participation in clinical studies. Controversy and concern have surrounded these actions, however. Two of the claims that have been made are: (1) that women are more difficult to study than men because of their cyclical hormonal changes; and (2) that conducting gender-specific subgroup analyses would increase the size of study populations, raise the cost of studies, and thereby reduce the number of studies that could be performed with the limited resources available. In addition, controversy over the inclusion of women of childbearing potential and pregnant women has been particularly salient. Concerns have been expressed about avoiding potential harm to existing or potential fetuses and about the possible legal and financial ramifications of such harm. A further concern involves the perceived difficulties in enrolling women in studies and retaining them for the duration of the studies.Against this backdrop, the Office of Research on Women's Health at the National Institutes of Health (NIH) asked the Institute of Medicine (IOM) in October 1992 to establish the Committee on the Ethical and Legal Issues Relating to the Inclusion of Women in Clinical Studies. The Committee's charge was to: (1) consider the ethical and legal implications of including women, particularly pregnant women and women of childbearing potential, in clinical studies; (2) examine known instances of litigation regarding injuries to research subjects [End Page 55] and describe existing legal liabilities and protections; and (3) provide practical advice on these issues for consideration by NIH, institutional review boards (IRBs), and clinical investigators.The 16 Committee members came from diverse backgrounds: bioethics, law, epidemiology and biostatistics, public health policy, obstetrics and gynecology, clinical research, pharmaceutical development, social and behavioral sciences, and clinical evaluative sciences.1 Chaired by two of the authors of this article, Ruth Faden and Daniel Federman, and coordinated by the third, IOM Study Director Anna Mastroianni, the Committee met five times over a fourteen-month period, convened a one-and-one-half day invitational workshop, and commissioned several background papers. The ‘Black Lives Matter’ movement has exposed structural racism’s contribution to these health inequities. ‘Cultural Safety’, an antiracist, decolonising and educational innovation originating in New Zealand, has been adopted in Australia. Cultural Safety aims to dismantle barriers faced by colonised Indigenous peoples in mainstream healthcare by addressing systemic racism.This paper explores what it means to be ‘culturally safe’. The ways in which New (...) Zealand and Australia are incorporating Cultural Safety into educating healthcare professionals and in day-to-day practice in medicine are highlighted. We consider the ‘nuts and bolts’ of translating Cultural Safety into the UK to reduce racism within healthcare. Listening to the voices of black, Asian and minority ethnic National Health Service (NHS) consumers, education in reflexivity, both personal and organisational within the NHS are key. By listening to Indigenous colonised peoples, the ex-Empire may find solutions to health inequity. I will begin with an examination of how musical meanings are politically rendered, and how these understandings are attached to moral consequences. Highly resistant to classification, musical meanings are those things we come to understand about ourselves through music, as opposed to musical knowledge which is demonstrable know-how. (...) While marching bands and flute sonatas can be judged with scores estimated to the 100th decimal point, the meanings that are created between the standards of practice of a given genre and the worldview of the listener or performer are provisional at best. Seen in this light, even seemingly secure or knowable realms like Christian heavy metal or anti-war movies are in fact highly un-objective and unpredictable. The challenge this paper seeks to uncover is participation on the hither side of fact, where understandings are rendered in a world that is contingent, political, and always in motion. What better example of the unclassifiable than the moving axes of politics and art?So what occurs between art and human or so-called "world" experience? [End Page 144] Let's agree that there is always motion, non-neutral, political movement in this interaction. We need not be students of French post-structuralism to recognize that we are part of many ever-evolving human-made systems, some of control, regulation, reward, punishment, and pleasure, but each with their own gravitation pull.1 I like Susan Sontag's take the best when she wrote that every place, every history has its own "sensibility," its own ineffable way of being in the world.2 Sensibilities—perhaps a clearer way of referring to politics in the context of art and experience—do not exist apart from their environment, yet they are more elusive than an idea or recognizable behavior.3 The sensibility of a time and place makes possible multiple discourses through which we make meaning.4 Some discourses, Foucault would remind us, are intensified by a history's particular sensibility and so appear louder than others. Such a discourse might speak so loudly that it shapes the meanings we make, drowning out options, and thus appearing obvious or commonsensical. The logic of musical assessment and evaluation—scoring marching bands and flute sonatas to the 100th decimal—is one such example.In spite of authoritative voices and reasonable discourses, each history's sensibility has its own escape routes, its own distortions and contradictions. I am fascinated by how we comply with or resist these pulls, as they are matters of agency and identity, matters of equity and social justice. In the present-day context of neo-liberalism and conservative values, especially 21st Century American fundamentalism, we would do well to ask how—not whether—such a fundamentalist sensibility shapes our ways of doing and knowing.5 My attempt is to locate music education in such a project.Shortly after the invasion of Iraq, I wrote a short piece on the fundamentalist imagination and its pull on the arts and education.6 This research took place at the 2003 MENC biennial where Bennett Reimer asks philosophy SRIG participants to consider (among other things) the role of metaphor in music education.7 I viewed the fundamentalist imagination as antithetical to metaphor: to paraphrase, the fundamentalist philosophy of education was "a philosophy for, not with, its initiates. Judgments are passed, not reached; answers are given, not argued... [Most importantly,] it is an educational method that emphasizes and then measures what is literal."8Since then, the voices of American literalism have appeared in increasingly loud volume seeking to discourage interpretation and argument in favor of handed-down teachings and binary logic. Supreme Court Justice Antonin Scalia decries the folly of a "living" constitution, in favor of a strict or literal reading. Retired Cardinal Bernard Law of Boston, in response to a common ground initiative by the late Joseph Bernadin, labels an appeal to "dialogue" a "fundamental flaw."9 Law sniffed, "Dissent from revealed truth or the authoritative [End Page 145] teaching of the church cannot... This article presents the design of, and students' responses to, a Web-enhanced course titled “Inquiry Methods Integrating Science, Mathematics, Technology, and Society (MSTS) in Elementary Grades.” The course was part of the pilot test of a novel approach to a compressed-time alternative pathway masters of arts in teaching degree for career-change students in elementary education. Students' responses indicated this approach to MSTS and inquiry served to unify many of the other courses in the degree program.

Since the publication of Kit Fine's “Essence and Modality”, there has been lively debate over how best to think of essence in relation to necessity. The present aim is to draw attention to a definition of essence in terms of modality that has not been given sufficient attention. This neglect is perhaps unsurprising, since it is not a proposal made in response to Fine's 1994 paper and ensuing discussion, but harks back to Ruth Barcan Marcus's earlier work in the (...) 1960s and 1970s on essentialist claims. At the core of Barcan Marcus's account is Minimal Essentialism, of which there are several extensions, in particular, for cases of referential predicates (such as “x is identical to Socrates”), Individuating Essentialism, and Aristotelian Essentialism. I argue that Minimal Essentialism fares favourably against a host of familiar examples. I close with some historical observations, that the distinction between essence and necessity was already commonplace in the early days of quantified modal logic and its philosophy. (shrink)

The relationship of language to cognition, especially in development, is an issue that has occupied philosophers, psychologists, and linguists for centuries. In recent years, the scientific study of sign languages and deaf individuals has greatly enhanced our understanding of deafness, language, and cognition. This Counterpoints volume considers the extent to which the use of sign language might affect the course and character of cognitive development, and presents a variety of viewpoints in this debate. This volume brings the language-thought discussion into (...) a clearer focus, both theoretically and practically, by placing it in the context of children growing up deaf and the influences of having sign language as their primary form of communication. The discussion is also sharpened by having internationally recognized contributors, such as Patricia Siple, Diane Lillo-Martin, and Ruth Campbell, with specialties in varied areas, all converging on a common interest in which each has conducted empirical research. These contributors clarify and challenge the theoretical assumptions that have driven arguments in the language-thought debate for centuries. An introduction by the editors provides a historical overview of the issues as well as a review of empirical findings that have been offered in response to questions about language-thought relations in deaf children. The final chapters are structured in the form of "live" debate, in which each contributor is given the opportunity to respond to the other perspectives presented in this volume. (shrink)

This book reminds us in yet another context that women's contributions to science can be rendered invisible by “the historical record.” The Manhattan Project, the supersecret midcentury United States research, development, and production enterprise that produced the nuclear bomb, was a massive undertaking, at one time employing 130,000 persons. About 10 percent were women, yet official histories made no mention of female scientists or engineers.Sleuthing by the physicists Ruth Howes and Caroline Herzenberg has documented Manhattan Project contributions by more (...) than three hundred women. Howes and Herzenberg begin with a few well‐known European women pioneers in nuclear science , none Americans and none available for the U.S. bomb effort. They then recount the history of the Manhattan Project via biographical vignettes of women, organized in chapters: “The Physicists,” “The Chemists,” “Mathematicians and Calculators,” “Biologists and Medical Scientists,” “The Technicians,” and “Other Women of the Manhattan Project.”It appears that few of these women knew each other. In her foreword, Ellen Weaver writes: “When I read the personal reminiscences of the men who were nuclear pioneers, I'm struck by the importance they place on their friends and associates, and on the often intense interaction among them, which could lead to major insights in both theory and practice of science. And I'm a bit jealous. By and large, women did not share in that give‐and‐take.”Not only was there little networking among women scientists and technicians in the early 1940s while the bomb was being developed, but there was little opportunity for them to share their experiences later. Only a very small percentage of these women were able to continue their professional careers. The many barriers to women as professional scientists and engineers, temporarily lowered owing to the manpower shortages of wartime, were raised after the war. There did not develop a community of women, engaged in teaching and research, with roots in the Manhattan Project.A web page is being developed to gather and provide further information about the women scientific workers of the Manhattan Project. Howes and Herzenberg are setting up an on‐line archive there, hoping that others who have information about the women scientific workers of the Manhattan Project will contact them via the web page or by email .The magnitude of their endeavor to learn about these women was illustrated vividly to me while writing this review. I attended the memorial service for my aunt, Mary Matilda Morrison Pendleton , and heard in her eulogy that “she worked as a nurse at the Hanford project, near Richland, Washington, where the government was secretly making atomic bombs. She would work shift work, two weeks of day shift, two weeks of swing shift, two weeks of graveyard shift, then she would get seven days off. She wore a badge every day that was checked after each day's work to see how much she had been radiated.” Although I thought that I knew her well, my aunt's role in the Manhattan Project had been unknown to me.The women of the Manhattan Project are finally gaining visibility. For example, Nancy Cook Steeper's book‐length biography of Dorothy Scarritt McKibbon is being published by the Los Alamos Historical Society. Howes and Herzenberg have provided ideas and starting points for many additional biographical projects. Perhaps the greatest long‐term value of their book is the impetus that it will give to further research.The book is well written, easy to read, and attractively printed. An appendix, listing the women and their roles, and a thorough index combine to make this an easily used reference work. There is also an informative sixteen‐page chronology that focuses on the crucial period from 1938 through 1945. (shrink)

The present offers a pragmatic solution of the Heap Paradox, based on the idea that vague predicates are “indexical” in the sense that their denotation does not only depend on the context of their use, but it is a function of the context. The analysis is based on the following three claims. The borderlines of vague terms are undetermined in the sense that though they may be determined in some contexts, they may differ from one context to the next. Vagueness (...) serves the important communicative function, enabling speakers to identify entities as objects (as things we can talk about) in terms of some quantitative differences between the “object” and its background in the context. Thus, in some contexts we can naturally partition the group of men uniquely so as to distinguish the bald from the not-bald. Whether a man with a given hair number is among the bald in a given context depends not only on his own hair number but also on the hair number of others in that context. This provides the background for the claim that when we assert that John is bald, we presuppose that there is a unique demarcation to the bald in that context. I consider the truth of the Paradox’s statements in contexts where the presupposition is true and in contexts where it is false. The analysis yields that the contradiction is avoided because though each of the statements is often true, never are all the sentences in the Paradox true together. (shrink)

The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. We empirically tested Hemelrijk's agent-based model, in which dyadic agonistic interaction between primate-group subjects determines their spatial distribution and whether or not the dominant subject has a central position with respect to the other subjects. We studied a group of captive red-capped mangabeys that met the optimal conditions for testing this model. We analyzed the spatial distribution of the subjects in relation to their rank in the dominance hierarchy and the results confirmed the validity of this model. In accordance with (...) Hemelrijk's model, the group studied showed an ambiguity-reducing strategy that led to non-central spatial positioning on the part of the dominant subject, thus confirming the model indirectly. Nevertheless, for the model to be confirmed directly, the group has to adopt a risk-sensitive strategy so that observers can study whether dominant subjects develop spatial centrality. Our study also demonstrated that agent-based models are a good tool for the study of certain complex behaviors observed in primates because these explanatory models can help formulate suggestive hypotheses for exploring new lines of research in primatology. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. Philosophical debates about the metaphysics of time typically revolve around two contrasting views of time. On the A-theory, time is something that itself undergoes change, as captured by the idea of the passage of time; on the B-theory, all there is to time is events standing in before/after or simultaneity relations to each other, and these temporal relations are unchanging. Philosophers typically regard the A-theory as being supported by our experience of time, and they take it that the B-theory clashes (...) with how we experience time and therefore faces the burden of having to explain away that clash. In this paper, we investigate empirically whether these intuitions about the experience of time are shared by the general public. We asked directly for people’s subjective reports of their experience of time—in particular, whether they believe themselves to have a phenomenology as of time’s passing—and we probed their understanding of what time’s passage in fact is. We find that a majority of participants do share the aforementioned intuitions, but interestingly a minority do not. (shrink)
